Retail Criminal Pleads Guilty to Indictment

David J. Miller

David J. Miller, 60, of Williamsville, pleaded guilty before State Supreme Court Justice M. William Boller to:

• One count of Grand Larceny in the Third Degree (Class “D” felony)

• Two counts of Grand Larceny in the Fourth Degree (Class “E” felonies)

• One count of Petit Larceny (Class “A” misdemeano

Between June 9, 2023 and June 20, 2023, the defendant stole merchandise from two different retailers on four different dates. None of the merchandise was recovered from the first three transactions, resulting in a loss of $12,916 to the retailers. The property from the fourth transaction was recovered following Miller’s arrest on June 20, 2023 and returned to the retailer.

As part of the plea, Miller is required to sign a confession of judgement for each retailer as well as a trespass notice for each retailer which rescinds Miller’s legal right and privilege to enter the retailer’s stores.

Miller faces a maximum of 7 years in prison when he is sentenced on June 14, 2024 at 9:30 a.m. as a second felony offender. Jurusik of the Special Investigations and Prosecutions Bureau’s Retail Crimes Task Force.
